Buddy, it looks like its only you and me remaining who has not received the FP notice. For me its been 30 days since opening SR and nothing. We are the unfortunate ones who have not only not received FP but our application are in TSC , where opening an SR is of no use.
I am July 2 filer (@TSC), still waiting for FP notice. Got I-485 receipt (ND Aug 27), and approved EAD and AP. Did not call for SR yet.

If the options are sign or do not sign and no EAD/GC for a long long time or never, I would just sign the damn thing. This contract is way too restrictive and lawyers will find lot of loopholes. Let him go to court. If he dares to, what do you lose? $10,000? He has to spend more than that, face publicity, lose reputation among clients ( send the freaking agreement to all his clients and advertise in all awebsites) and intense scrutiny by Homeland Security and possible arrest. Just somehow document all your conversations which implicate him and be prepared.

I don't believe it must be FIFO...just as what I told in the other forum.
It must be:
FIFT - First In, First Touch
and then;
FCFO - First Complete, First out
(Complete: approvable and PD current)

In your analogy you are forgetting the company (USCIS) still promoted that Test Lead to Manager even though he wants all those benefits from the very first day(INA law).
In other words it is a law per USCIS! So stop cribbing because it doesnt suit you.

Still waiting for the receipts..
In your case, I think u should give it a day or two.

My checks were cashed yesterday. My application reached NSC on July 14. My I-140 was also approved from NSC.
I got the receipt numbers from the back of the checks, however when I entered them on the USCIS website, it said that the numbers were invalid. Any idea if I need to wait another day or so before the system will accept them?

I send my Employment based I-485/I-765/I-131 application on June 29th 2007 and received at NSC on July 2nd 2007 (USPS Express mail tracking no. XXXX). It�s more than 100 days and I didn�t even received the Receipt Number for all the applications.
I have following question for CIS Ombudsman�s office:
1) Per US Law, I have to get the EAD in 90 days of filling of my application? How I can get the EAD in 90 days where I didn�t even get the Receipt Number after 100 days?
2) Why �First In First Out (FIFO)� process is not followed by USCIS for receipting? It�s unfair to applicant like me when application filed on August 17th 2007 enjoying the EAD card and able to work.
3) What action you can will take to force USCIS follow their own operational manual guidelines and follow FIFO in future?

Well, you assume family members can get AP and EAD after submitting I-485. Not true for many people. Take myself as an example, I was not lucky enough to file my I485 in 2007. So with a PD of early 2007, I have none of the benefit from AOS at all.
Although for me it's not a big deal because my wife will soon get her PhD and will file for her own immigration petition. This actually works better for us, because it will make the line much shorter and both of us will get the green card much quicker.
However, for those who do not work and solely depend on their spouses to get green card. This change can spell disaster for them during the long wait caused by retrogression without the ability to file AOS.

My wife and I just got receipts for our I-485, I-140, AP and EAD. The "received date" is July 7 and the "Notice Date" is September 13. I also confirmed that the checks were cashed.
I remember my attorney saying that the applications were filed at NSC but somehow my receipts came from VSC. And this morning I receive an update that my I-485 has been transferred to TSC! Here is the detail:
"On September 20, 2007, we transferred this I485 APPLICATION TO REGISTER
PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. We sent you a notice of this transfer".

This thread just puts things in perspective. Getting a GC and beyond is a good thing, but in the larger scheme of things, enjoying the present moment and enjoying what you got is far more important. You never know when it can end !

If you use AP you enter the US as a "parolee". (Is that how you spell it?).
If you use AVR I believe you enter as an H1B. I would prefer to enter as an H1B
since I have not yet used my EAD or AC21.
To clarify - are you suggesting that it is advisable to use AVR if you have both AP and AVR, and you have not used EAD or AC21 so far. Also, my spouse and myself could be returning at different times in to the country from Canada. Does this change the preference of using either AVR or AP. Since I am the primary applicant but of course we plan to land together.

We are making great progress on this and glad to see tonnes of positive responses. I was never a fatalist but the GC process made me one... to a certain extent... Came to US in 96 as a student... First PD 1999... layoff in 2001... 2nd PD 2002... company shut down... 3rd PD 2003... PD cleared 7 days after 2005 retro! That was the worst period and I was so frustrated at the time!June 1st 07 filer... Was waiting for FP, EAD forever. Finally on sept 13th I had my FP and sept 17th my GC... just like that... no LUD, EAD, AP nothing... directly GC in the mail... I guess it was just my time! Looking back I think I am glad I concentrated on the positives that were going on in my life... thats pretty much the only thing one can do to aviod frustration... IV is a great organization and hopefully their efforts will bring fruits! Meanwhile good luck to u!
