What does ADIT processing means any idea is that we need to go to local USCIS office for the interview?
Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
I posted it in a new thread but it is not appearing in the home page links
ADIT (I-551) stamping
•
Applicant appears at local USCIS for ADIT processing. Applicant will not be scheduled for an ADIT appointment, ADIT processing is done by "walk-in" basis ONLY.
•
Once the applicant adjusts his/her status by completing ADIT processing, s/he is given the I-551 permanent resident stamp in his/her passport.

My sincere apologies for being harsh on IV members, I sincerely appreciate the efforts.
I guess Oct bulletin (EB3 - I) got me going there...
I realize it's not fair to criticize when I am just sitting on the sidelines and not contributing to the cause.
Peace.
Good gesture rahulp!

Did anyone see Byron Dorgan's (Democratic Senator from North Dakota)interview on Stephen Colbert last night? This guy just wrote an anit-outsourcing book (http://www.amazon.com/Take-This-Job-Ship-Brain-Dead/dp/031235522X --no I am not plugging his book!) and he is full of 'they stole our jobs' rhetoric. This is typical outsourcing/globalization-bashing democratic mentality and it's disturbing to seeit still persists 2 years after Presedential elections.
Am I the only one who thinks that if Democratics takes over the House, we are screwed?
If the Democrats  win, we will be screwed because the illegals will get all the visas.
If the Republicans   win, we will also be screwed because nobody will get visas.

I wonder how many who come here on H4 know what complexities lay ahead in the G.C processing. unfortunately it is not easy to undo their marriage and go back.
They need a fair deal too just like the way those in EB-3 are waiting for a proposal that addresses their issues more directly rather than trickle down. I guess u r one of them.
I dont know how much u know about G.C before u came here. I am yet to understand it clearly.
--MC
I agree with MChundi here. I have been in this process since 2002 and have worked closely with my lawyers but it never ceases to amaze me how much complexity is built into the GC system. Putting the ads, applying for labor, aplying for I-140 answering any throwbacks from DOL/UCSIS. TO add to that the goof ups by the immigration lawyers and their para-legals certainly confuses the hell out of u.
Most ppl who apply for GCs are unaware about retrogression and PBEC problems at the onset. Even if they are aware u think, "well, my labour will take abt a year or so so by then hopefully things will become current". I mean not a lot of us, have the time or the foresight to plan THAT much in advance.
Now if we as H1s dont know the deal here, H4's CERTAINLY dont know the deal and it takes them a LOT more time to grasp the reality of things coz they have to absorb many other things like learning how to drive here, learning how the credit system works here etc etc etc.
All that being said, i would ask the H4's to try and avoid pointing blame at the IV members. This is not an easy process for sure. We are in NO position to demand anything from the US Govt. Whatever progress we have made is also quite phenomenal. I Still cant believe we collected even $100,000+ !! Right now the best strategy is to solve the primary applicant's problems and try and get the dependents problems go away along with that.

it says nothing about who can file an application.
it only says the "status may be adjusted" IF.....
I-485 application is nothing but application to "adjust the status". Section 245 govern the area of I-485 filing and approval (or denial).
Also, read (3) again in previous post
an immigrant visa is immediately available to him at the time his application is filed.
Do you know that "his application" means here. Right, it is I-485 application.

Setting up company is just the first step for Self-Employment. The key things is to demonstrate that new job is in same/similar classification and company has offered "bonafide" job, not just job on paper.
BTW, it is not necessary to have LLC. The corporate structure could be S-Corp or C-Corp also.

In this enforcement climate, self-employment is risky too. The memo is not a binding rule. Having said that, even if any one chose to self employment, they must have very proper documents including long-term contract agreement with few clients, that explanis the service you provide shold be in-line with orginal I-140 job duties. In current H1B denial rate becuse of client letters RFE, the self employed AC21 cases shold be more prepared, in case of RFE.

I agree that we need to strengthen IV by contributing our time, money. But, to me it looks like most of the successes(how small they are) of IV are making EB3 suffer more. Not anything against EB2 guys, don't start a war please. I think IV should concentrate more on EB3. I have seen vocal EB2 people writing against EB3 in these forums. But do we really have to suffer like this?
I agree completely with vdlrao and pappu. We are doing our best to put lot of efforts to sort this out by volunteering. What is your guess, how many people stuck in GC mess in the DC Metro area? Thousands, right????? We had a State Chapter meeting for Maryland, Virginia and DC and you know how many show up for the meeting ????? Take a guess...15!!!! You guys just know how to yell and scream at this blog. Convert your anger into something constructive......IV is not the President of this country that would go ahead and pass legislation to bring you relief. It is the lawmakers.....This has to be collective effort. I will like each one of you to first donate, volunteer before coming to this site to blame the organization. You should be thankful to the people running this show putting their time and energy for our cause. President of this country is having hard time to pass a legislation on health care and you expect IV with help of couple of people can get you legislative relief with couple of hundred dollars!!!! Guys wake up to the reality and contribute to IV.....Work with your state chapters...There are lot of people ready to take initiative through your state chapters but they find no one supporting them. Insurance companies are contributing billions of dollars to lobby against a bill. And if you cannot move out of your couch to volunteer, shut up and just wait for next bulletin....

Kennedy, McCain, 2 congressmen meet
By Jerry Kammer
COPLEY NEWS SERVICE
December 9, 2006
WASHINGTON Two of the most liberal members of Congress met with two of their most conservative colleagues this week to revive immigration legislation that passed the Senate but was throttled by House Republican leaders who resisted its attempt to grant citizenship to illegal immigrants.
Sen. Edward Kennedy
The plan is to bring the bill up in late winter, said Rep. Jeff Flake, R-Ariz., a conservative stalwart who attended the meeting in the office of Sen. Edward Kennedy, D-Mass. The other participants were Sen. John McCain, R-Ariz., and Rep. Luis Gutierrez, D-Ill.
The strategy session Wednesday came amid speculation about how the dynamics of the immigration debate might change, if at all, when Democrats take control of the House and Senate next month.
Flake said that Kennedy, who will be chairman of the Senate Judiciary Committee's immigration subcommittee, wants to let the new Congress deal first with issues such as the war in Iraq and proposals to raise the minimum wage.
Then he'll be ready to go with a new version of the bill that the Senate approved in April.
Sen. John McCain
Republicans ran the show in both houses of Congress then, and passionate divisions in their ranks over immigration policy became a dominant feature of the debate. Democrats, particularly in the House, were mostly content to sit back and enjoy the stalemate, even as they campaigned against the do-nothing Republican Congress.
Now Democrats face the hazards of immigration politics.
Immigration-law changes are conspicuously absent from the legislative agenda laid out by incoming House Speaker Nancy Pelosi. Observers here say it will be difficult for Pelosi, D-San Francisco, to honor her campaign-season pledge to work for a new comprehensive immigration law without splitting a caucus that includes freshly elected Democrats who vowed to secure the border and crack down on illegal immigration.
The November midterm elections seemed to send mixed messages.
Rep. Luis Gutierrez
In a cliffhanger contest, Arizona Rep. J.D. Hayworth, a conservative Republican and strident foe of illegal immigration, was defeated by Democrat Harry Mitchell.
Immigration advocates such as Ben Johnson of the Immigration Policy Center say Hayworth's defeat showed that immigration did not turn out to be the firebrand issue that some people thought it could be.
But immigration restrictionists point out that Mitchell made getting tough on immigration the centerpiece of his campaign. They also say Mitchell cleverly used the issue against Hayworth, saying his Republican opponent was part of a political regime that wasn't competent enough to stop the hundreds of thousands of immigrants that sweep across Arizona's southern border each year.
While Mitchell said he favored legal status for long-established immigrants, he insisted that immigration policy can be fixed only by members of Congress who are willing to enforce the law, produce real immigration reform and stop playing politics with the issue.
Rep. Jeff Flake
That enforcement-heavy approach is fine with immigration advocates as long as it is part of a package that provides permanent legal status to those who are beckoned across the border by agriculture, restaurant, construction, landscaping and janitorial jobs. The number of illegal immigrants in the United States is estimated to be at least 11 million.
Immigrant-rights advocates, along with their allies at the National Chamber of Commerce and other business organizations, also support a proposal to provide hundreds of thousands of low-wage workers every year for employers who demonstrate that they are unable to find Americans to fill the slots.
While McCain and Kennedy describe this as a temporary-worker program, the legislation they sponsored would put the workers on a path to citizenship.
At a time of anxiety about the loss of good-paying manufacturing jobs, the McCain-Kennedy bill's efforts to import low-wage labor has drawn the anger of critics across the political spectrum. That is why Mark Krikorian of the Center for Immigration Studies, which advocates immigration restrictions, predicts Pelosi will be reluctant to get behind a proposal that could endanger the new Democratic majority.
Nancy Pelosi knows the Democrats are on probation for the next two years, Krikorian said.
He predicted that Pelosi would back less ambitious immigration change, such as a plan to provide legal status to undocumented students, rather than take on the explosive issue of mass legalization, which critics condemn as an amnesty that would spawn more illegal immigration.
But Frank Sharry, executive director of the National Immigration Forum, which advocates for immigrant rights, argues that next year will be pivotal because of the presidential race that follows.
I think that once we hit primary (election) season, controversial issues get a lot harder to do, Sharry said. Everybody I talk to says 2007 is the window of opportunity.
Pelosi was noncommittal this week on whether the House would take up immigration legislation. She sought to deflect some of the responsibility to the White House, suggesting that she expects President Bush to offer more specifics than his call to match willing worker with willing employer.
That's up to the president, Pelosi said. We want to work closely with him because it has to be comprehensive and bipartisan.
President Bush's political advisers, meanwhile, have acknowledged that revamping immigration law may be necessary to shore up sagging support for Republicans among Hispanics, the nation's fastest-growing ethnic group. Republicans received just 30 percent of the Hispanic vote this year, down from 44 percent in 2004.

I can't understand why Sanhari's suggestion would rile up EB2 folks. All he suggested was to use the EB spillover visas for oldest cases irrespective of EB category and country.
Sanhari - Are you sure that this is a USCIS decision? Can USCIS change the way the do the spillover without legislation change?
Folks, There is a another thread on here that says IV is neither against EB3 nor for EB2. If that's really the case why would Sanhari's suggestion not find favor? If IV seriously want to do something for the backlog, Sanhari's suggestion should be taken up.
I anticipate and welcome reds, greens, blues for this post :)
as gc28262 has indicated, that proper analysis and the correct interpretation of the law is needed to change such matters. Unless, EB3 people come out of the lethargic content/self pity and start working on the issues as if their life depended on it (it does) - just writing to the senators and representatives will not help. The legislative offices is not going to do the analysis (in the time that matters to us) and address it to the USCIS. However, if we do the ground work and then approach them, we may have a better chance of succeeding.
